Terms of sale

Preamble

These General Terms and Conditions of Sale (GTC) apply to all orders placed on the lunavenstudio.com website. By validating your order, you unreservedly accept these conditions and a contract is formed between the buyer and the Seller, hereinafter referred to as.

2. Products

The essential characteristics of the products and their respective prices are made available to the buyer on the lunavenstudio.com website. The choice and purchase of a product are the sole responsibility of the buyer. The products are offered within the limit of available stocks, as specified at the time of purchase.

The products are artisanal creations, handmade by the Seller. They are therefore unique and may differ from the presentation photographs.

The products offered for sale on the site are as follows: crochet and embroidery decorative items (embroidered hoop, frames, plushies, figurines, ornaments), crochet and embroidery accessories (totebags, pouches, key rings), digital tutorials.

3. Prices

The prices of the products are indicated in euros, excluding VAT and excluding delivery costs, the Seller being a self-employed business, is exempt from VAT and must invoice its sales excluding tax. The Seller reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the rates in effect at the time the orders are recorded.

Prices do not include shipping and delivery costs, which are charged in addition, under the conditions indicated on the site and calculated prior to placing the order.
The payment requested from the buyer corresponds to the total amount of the purchase, including these costs.

The Seller is not responsible for any additional taxes related to imports; it is up to the buyer to pay any customs fees.

4. Order

To place an order, the buyer must follow the online ordering process and click on "Validate order" to finalize the purchase. The buyer must fill in the information necessary for the delivery and proper processing of the order. The buyer has the option to go back and check the accuracy of their choices and the information provided. The sale will be considered final after validation of the payment. Confirmation of the order entails acceptance of the General Conditions of Sale and forms the contract. The Seller will send an email confirming receipt and payment of the order.

The Seller reserves the right to cancel or refuse any order from a buyer with whom there is a dispute regarding the payment of a previous order.

The Seller may also cancel or refuse an order if it is unable to honor it as is (selection of a product out of stock, delivery choice that does not correspond to the selected products).

5. Payment

Payment is due in full and immediately upon ordering, including for pre-ordered products. The buyer can pay for their order by credit card, PayPal, or any other means of payment offered on the site.

Payment data is exchanged in encrypted mode using the protocol defined by the approved payment service provider involved in banking transactions carried out on the lunavenstudio.fr site.

Payments made by the buyer will only be considered final after the Seller has actually collected the amounts due.
The Seller will not be required to deliver the products ordered by the buyer if the latter does not pay the price in full under the conditions indicated above.

6. Delivery

The products are delivered to the delivery address indicated when ordering, in the delivery areas made available by the Seller, namely mainland France and the countries of the European Union. Delivery times are given for information purposes only and may vary depending on the destination and the delivery method chosen. The Seller cannot be held responsible for the consequences due to a delay in delivery, an error in the wording of the delivery details, material damage or loss of the products, once the order has been sent.

If the order is subject to customs taxes on arrival, the Seller cannot be held responsible and it will be up to the buyer to pay the additional costs.

7. Right of withdrawal

In accordance with the law, the buyer has a period of 14 days from receipt of the products to exercise his right of withdrawal without having to justify reasons or pay penalties. The return costs are the responsibility of the buyer.

8. Return of products

To exercise the right of withdrawal, the buyer must notify his decision to withdraw by e-mail to contact@lunavenstudio.com with the following information: order date, order number, date of receipt of order, name, address and e-mail of the buyer, and expressing the desire to withdraw by specifying the products concerned.

The products must be returned in their original condition and complete (packaging, accessories, instructions) allowing their resale in new condition, accompanied by the purchase invoice. Damaged, soiled or incomplete items are not taken back.

9. Refund

In the event of withdrawal by the buyer, the Seller will refund the payments received from the buyer, with the exception of delivery costs. The refund will be made using the same means of payment as that used for the initial transaction, unless the buyer expressly agrees to a different means. The refund will not incur any costs for the buyer.

10. Guarantees

All products supplied by the Seller benefit from the legal guarantee of conformity provided for in Articles L.217-4 et seq. of the Consumer Code and the guarantee against hidden defects provided for in Articles 1641 et seq. of the Civil Code. It will be up to the buyer to prove that the defects existed at the time of sale and are such as to make it unfit for the use for which it was intended. In the event of non-conformity of a product sold, it may be returned, exchanged or refunded.

11. Liability

The Seller cannot be held liable for damage resulting from improper use of the product purchased, negligence or lack of maintenance on the part of the buyer, as in the event of normal wear and tear of the product, accident or force majeure.

The photographs presented on the site are not contractual and cannot engage the liability of the Seller. Each product is handmade and may therefore differ from the photographs appearing in the product presentation. If the product sold is in a defective condition, the Seller will specify this on the product page with a "B-type" or "C-type" gradation, and the buyer will then be informed before purchase, which excludes him from making a claim upon receipt.

The Seller's liability will, in any event, be limited to the amount of the order.

12. Intellectual property

All elements of the lunavenstudio.com site are and remain the intellectual and exclusive property of the Seller. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio. Any failure to comply with this prohibition may constitute an offense of counterfeiting.

13. Personal data

The Seller undertakes to preserve the confidentiality of the information provided by the buyer. These will only be used to process the order and to strengthen and personalize communication, in particular through information emails and as part of the personalization of the site based on users' observed preferences. The processing of this information complies with the General Data Protection Regulation (GDPR).

The buyer is informed of the collection of this data necessary for the sale of the products and their delivery. In application of article 34 of the "Informatique et Libertés" law of January 6, 1978, the buyer has a right to access, modify and delete his personal data. He can exercise this right by contacting the Seller at the email address contact@lunavenstudio.com.

When purchasing, the buyer is invited to check a box giving his consent to receive informative and advertising emails from the seller. The buyer can unsubscribe at any time by clicking on the unsubscribe link contained in each email.

14. - Applicable law - Language

These General Terms and Conditions of Sale and the transactions resulting from them are governed by and subject to French law.

These General Terms and Conditions of Sale are written in French. In the event that they are translated into one or more foreign languages, only the French text will be authentic in the event of a dispute.

15. Disputes
